This Acceptable Use Policy ("AUP") governs everything you build, publish, sell, send or store using ElasticFunnels: pages and funnels, checkouts, CRM records, automations, emails and texts, calls, and anything generated with our AI tools. It forms part of our Terms of Service.
You are responsible for everything in your account, including what your team members, clients and agents do in it.
How this works
Direct response, ecommerce, info-product, B2B SaaS, lead gen and education funnels are explicitly welcome. We do not pre-screen your pages and we do not review your copy before it goes live.
So this policy runs mostly on reports and on what we see when something breaks. When someone tells us that a page, an offer or a message breaks the law or this policy, we look at it and act on it.
1. You must have the rights to what you publish
Do not publish anything you do not own or do not have a licence to use. This includes:
- Pages, copy, designs, images, videos or courses copied from someone else.
- Other companies' trademarks and logos, used in a way that suggests they endorse or sell your offer.
- Stock assets, fonts or music used outside the terms of their licence.
- Another person's name, likeness or voice without their permission.
If you believe your work is being used on ElasticFunnels without permission, use our infringement report form.
2. Content that is never allowed
The following is prohibited with no warning and no appeal. Accounts are closed immediately.
- Child sexual abuse material (CSAM), or any sexual content involving a minor, real or synthetic. We report it to the National Center for Missing and Exploited Children (NCMEC) and to law enforcement.
- Non-consensual intimate imagery, including synthetic intimate imagery of a real person.
- Content that sexually exploits or endangers anyone.
The following is also prohibited:
- Violent extremism or terrorism. Content that promotes, funds or recruits for it.
- Incitement to violence, credible threats, or harassment of a person or group.
- Hate content attacking people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation.
- Doxxing. Publishing private information about a person without consent.
- Malware, phishing or credential harvesting, including pages built to look like a bank, a payment provider, a government service or a login screen.
- Illegal goods and services, including controlled substances, weapons where their sale is unlawful, counterfeits, stolen data, forged documents and hacking-for-hire.
3. Impersonation and synthetic people
Do not use ElasticFunnels to show a real, identifiable person saying, endorsing or doing something they did not say, endorse or do, unless you have that person's permission. It does not matter how it was made or whether the person is famous. A generated celebrity endorsement, a cloned voice, a fabricated doctor or news segment, or an invented "as seen on" badge are all prohibited.
You may use synthetic presenters who are not real people, and you may use your own likeness however you like.
4. What you sell is your responsibility
The claims on your pages are yours, not ours. We do not review or approve them. Advertising and consumer-protection law applies to you wherever your buyers are, and you are the one who answers for it.
To be explicit: do not publish pages that impersonate a brand, a bank, a regulator or a public figure; that make false earnings or health claims; that present paid actors or invented reviews as real customers; that hide the price, the recurring nature of a subscription, or how to cancel; or that are structured as a pyramid or Ponzi scheme.
5. Payments and checkout
- Only process payments for the business and the products your merchant accounts are approved for. Do not process payments on behalf of another business (transaction laundering).
- Follow the rules of every payment processor and card network you connect. Where their rules are stricter than this policy, theirs apply.
- Show buyers the price, the billing frequency and the refund terms before they pay, and honour cancellations and refunds you have promised.
- Collect card details only in ElasticFunnels checkout fields. Never ask for card numbers, bank passwords or full government ID numbers in ordinary forms.
6. Email, SMS and calls
- Only email, text or call people who agreed to hear from you, or whom you are otherwise lawfully allowed to contact. Honour opt-outs promptly.
- Follow the law that applies to each channel, including CAN-SPAM for email, the TCPA and do-not-call rules for calls and texts in the US, and GDPR and ePrivacy rules in Europe.
- Identify yourself in every message and on every call. Do not spoof caller ID or sender addresses.
- Tell callers when a call may be recorded, where the law requires it.
- Do not send spam, and do not use purchased or scraped contact lists.
7. Your customers' data
- You must have a privacy policy on your pages that explains what you collect, and a lawful basis for collecting it.
- If you add advertising pixels or tracking scripts to your pages, you must get any consent your visitors' jurisdiction requires before they fire.
- Do not use ElasticFunnels to build audiences or profiles from sensitive categories, such as health conditions, sexual orientation or religious belief, where doing so is unlawful or breaks the ad platform's rules.
- Do not knowingly collect data from children under 16 or target offers at them.
8. Rules for how you use the platform
- Do not run bots or automated traffic to inflate visits, conversions or split-test results.
- Do not try to bypass plan limits, billing, domain verification or access controls.
- Do not probe, scan or attempt to breach the security of the platform, or access an account or brand that is not yours.
- Do not use AI features to generate anything this policy prohibits.
- Do not use ElasticFunnels as a general file store or to host files unrelated to your funnels.
9. How we enforce this
What we do depends on what happened. In most cases we contact you first. For the categories in section 2, we do not.
- Notice. We tell you what breached the policy and give you a window to fix it.
- Removal. We may take a specific page, form or automation offline.
- Suspension. We may suspend publishing, messaging, checkout or the account.
- Termination. We may close the account, without refund, for serious or repeated breaches.
- Repeat infringers. We terminate accounts that repeatedly infringe copyright, as described on our report infringement page.
We may also preserve and disclose content and account records where the law requires it, or where it is necessary to protect someone from harm.
