Terms of Service

The short version
Use the platform for legal direct response, ecom, info-product, and B2B funnels. We charge what your plan says plus 0.5% on EF-hosted checkout. You own your data and can export at any time. We can suspend you for fraud or abuse, with notice and a chance to cure where possible. We will not arbitrate you into the ground.
1. Acceptance of terms
By accessing or using ElasticFunnels (the Service), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We will email you about material changes at least 30 days before they take effect.
2. What the Service is
ElasticFunnels is a SaaS platform for building, testing, and managing online sales funnels. It includes pages, same-URL split testing, AI tools, custom checkouts, CRM, automations, analytics, a built-in call center, and 38+ integrations.
3. Account, security, eligibility
You must be 18 or older. You are responsible for your account credentials and for all activity under your account. Notify us immediately of any unauthorized access.
4. Acceptable use
You will not use the Service to send spam, run illegal offers, host harmful or fraudulent content, infringe third-party rights, attempt to disrupt or reverse-engineer the Service, or violate applicable law (including FTC, CAN-SPAM, GDPR, CCPA, TCPA where relevant).
Direct response, ecommerce, info-product, B2B SaaS, lead gen, and education funnels are explicitly welcome. If you are not sure your use case is fine, ask us first; it is almost always a quick yes.
5. Fees and billing
Subscription fees are charged in advance per the plan you select. Overage fees (additional visits, domains, automation runs) are charged at the rates published on the Pricing page. The 0.5% processing fee applies only to revenue processed through EF-hosted checkout. External networks (ClickBank, BuyGoods, JVZoo, Digistore24) do not pass through EF and are not charged this fee.
Refunds follow the Refund Policy. We do not raise your subscription price during a paid term.
6. Your data, your rights
You own all data you create, upload, or generate while using the Service: contacts, orders, sessions, content, and CRM records. You grant us a limited license to host, process, and display that data solely to operate the Service.
You can export your data any time in standard formats (CSV, JSON). We do not lock you into proprietary formats. If your account is closed for any reason, you have 30 days to export your data before deletion.
7. AI and third-party providers
AI features in EF run on credits included with your plan and are processed through third-party AI providers selected by EF. We do not retain prompts or outputs beyond what is needed to operate the feature, and we never use your data to train any model.
EF is not liable for outages, errors, or content originating from third-party AI providers, but we will route around them when possible.
8. Intellectual property
EF retains all rights, title, and interest in the platform, software, and trademarks. You retain all rights to content you create. You grant us a limited license to display your content as needed to operate the Service.
9. Termination
You can cancel any time from the account dashboard. Access continues until the end of your current billing period.
We may suspend or terminate your account for clear Terms violations (fraud, abuse, illegal use). We will give you written notice and, where possible, a chance to cure. We will not terminate accounts in good standing without cause.
If we wind down a feature or product, we will give 60 days notice and prorate your fees.
10. Warranties and disclaimers
The Service is provided "as is." We do not warrant that the Service will be uninterrupted or error-free. We aim for 99.95% uptime and post incident updates at our status page.
11. Limitation of liability
To the maximum extent permitted by law, EF will not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is capped at the amount you paid us in the 12 months preceding the claim.
12. Disputes and arbitration
We try to resolve disputes by talking. If a dispute cannot be resolved that way, both parties agree to JAMS arbitration in Delaware (USA) under JAMS streamlined rules. You retain the right to bring claims in small-claims court. We do not require you to waive class action rights for claims of $10,000 or less.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles.
14. Changes to these terms
We may update these Terms over time. For material changes, we will notify you at least 30 days before they take effect, by email and a banner on the dashboard.
